1. Agreement to Terms

By accessing or using the Knodex platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

These Terms apply to all visitors, users, and others who access or use the Services. By using the Services, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Services

Knodex provides a self-service infrastructure platform that enables developers to deploy and manage cloud infrastructure. Our Services include:

Knodex OSS: Open-source, self-hosted version
Knodex Cloud: Managed platform with pre-built packages
Knodex Enterprise: Advanced features with enterprise support

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

3. Account Registration

To use certain features of the Services, you must register for an account. When you register, you agree to:

Provide accurate, current, and complete information
Maintain and update your information
Keep your password secure and confidential
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

4. Acceptable Use

You agree not to use the Services to:

Violate any applicable laws or regulations
Infringe on intellectual property rights of others
Transmit malware, viruses, or harmful code
Attempt to gain unauthorized access to systems
Interfere with or disrupt the Services
Engage in cryptocurrency mining without authorization
Store or transmit illegal content
Harass, abuse, or harm others
Impersonate any person or entity
Use the Services for competitive analysis

5. Intellectual Property

The Services and all content, features, and functionality are owned by Knodex and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit to the Services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with providing the Services.

6. Payment Terms

For paid Services:

Fees are based on your selected plan and usage
Payment is due according to your billing cycle
All fees are non-refundable unless otherwise stated
We may change pricing with 30 days' notice
You are responsible for all applicable taxes

Failure to pay may result in suspension or termination of your account.

7. Service Level Agreement

For Knodex Cloud and Enterprise customers, we provide service level commitments as specified in your service agreement. The general SLA targets:

95% uptime for the platform
Response times based on support tier
Scheduled maintenance windows with advance notice

Specific SLA terms are defined in your Enterprise agreement.

8. Data and Privacy

Your use of the Services is subject to our Privacy Policy. You are responsible for:

Ensuring you have rights to any data you process
Compliance with applicable data protection laws
Maintaining appropriate backups of your data

We implement reasonable security measures but cannot guarantee absolute security.

9. Third-Party Services

The Services may integrate with third-party services (e.g., AWS, Azure, GCP). Your use of these services is subject to their respective terms. We are not responsible for third-party services or their availability.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KNODEX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Knodex and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

Your use of the Services
Your violation of these Terms
Your violation of any third-party rights
Any content you submit to the Services

13. Termination

You may terminate your account at any time. We may terminate or suspend your access immediately, without notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Services ceases immediately. We may retain your data as required by law or for legitimate business purposes.

14. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.

15. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the Services or via email. Continued use after changes constitutes acceptance of the new Terms.

16. General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and Knodex.
Severability: If any provision is invalid, the remaining provisions remain in effect.
Waiver: Failure to enforce any right does not constitute a waiver.
Assignment: You may not assign these Terms without our consent.

17. Disclaimer

Knodex is not affiliated with the Kro project or Kubernetes SIG Cloud Provider. "Kro" and "Kubernetes" are trademarks of their respective owners. Any references to these projects are for informational purposes only and do not imply endorsement or affiliation.
